Right of Withdrawal

Right of withdrawal for consumers

A consumer is any natural person who enters into a legal transaction for purposes that predominantly can be attributed neither to their commercial nor to their self-employed professional activity.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day

  • on which you, or a third party other than the carrier indicated by you, acquired physical possession of the goods, where you ordered one or more goods in a single order and these are delivered together, or
  • on which you, or a third party other than the carrier indicated by you, acquired physical possession of the last of the goods, where you ordered several goods in a single order and these are delivered separately, or
  • on which you, or a third party other than the carrier indicated by you, acquired physical possession of the last consignment or the last item, where you ordered goods that are delivered in several consignments or items, or
  • on which you, or a third party other than the carrier indicated by you, acquired physical possession of the first of the goods, where you concluded a contract for the regular delivery of goods over a defined period of time.

To exercise your right of withdrawal, you must inform us (Richard Schürf GmbH, Solothurner Str. 49, 81475 Munich, Germany, telephone: +49 171 1481355, e-mail: info@freeheeler.eu) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

Cost of returning the goods: For returns within Germany we bear the direct cost of returning the goods; we provide you with a free returns label for this purpose. For returns from abroad you bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not exist, or expires early, for certain contracts, in particular for contracts for the provision of services connected with leisure activities where the contract provides for a specific date or period of performance (Section 312g(2) no. 9 BGB, German Civil Code). Accordingly, there is no right of withdrawal for our date-specific event tickets and bookings (Freeheeler Experience / FEO, workshops, testivals). Instead, our cancellation rules under the General Terms and Conditions (Section 8 of the Terms and Conditions) apply to these.

Voluntary 30-day return guarantee

In addition to the statutory right of withdrawal described above, we grant you as a consumer a voluntary return guarantee: you may return goods purchased from us within 30 days of receiving the goods. The timely dispatch of the goods is decisive for meeting the deadline. The condition is that the goods are returned complete, unused and – where available – in their original packaging.

This voluntary return guarantee applies in addition and does not restrict your statutory right of withdrawal or your statutory warranty rights; these remain unaffected by the voluntary guarantee. The same rules as for the statutory withdrawal apply to the refund and to the cost of returning the goods under the voluntary return guarantee (returns from Germany free of charge, returns from abroad at the customer’s expense).
